WEEZEVENT is a specialized site offering you the possibility of acquiring, directly via its websites, Tickets for Events set up by Organizers.
WEEZEVENT is merely an intermediary acting under a contract by which it is vested with the power to publish, manufacture, sell and market tickets on behalf of the Organizer.
Consequently, WEEZEVENT only acts at the stage of marketing the Tickets without intervening in any way whatsoever at the level of the organization of the show or the Event itself.
The Organizers remain fully responsible for the running of the Events.
Reservations are made in real time via WEEZEVENT servers based on the Event configuration data provided by the Organizer.
In this context, you are informed in real time of the availability of Tickets.
SCOPE OF APPLICATION
These General Conditions of Sale apply, without restriction or reservation, to any purchase of tickets offered for sale by SAS WEEZEVENT on its website.
You are required to read them before purchasing any ticket; the choice to use WEEZEVENT services is your sole responsibility.
The contract applies to the exclusion of all other conditions, including those applicable to other ticket sales channels. It can be viewed at any time on the WEEZEVENT website and will prevail over any other version or any other contradictory document.
Unless proven otherwise, the data recorded in the WEEZEVENT computer system constitutes proof of all transactions that you conclude with WEEZEVENT.
In accordance with the Data Protection Act of 6 January 1978, reinforced and supplemented by the GDPR (General Data Protection Regulation) which came into force on 25 May 2018, you have the right, at any time, to access, rectify, oppose, erase and transfer all of your personal data by writing, by post and providing proof of your identity, to:
You declare that you have read this contract and have accepted it by checking the box provided for this purpose before implementing the ticket ordering procedure. Validation of the ticket order constitutes your acceptance, without restriction or reservation, of this contract.
Finally, you acknowledge that you have the capacity required to enter into a contract and acquire tickets offered on the WEEZEVENT website.
This contract may be subject to future modifications. In this case, the version in effect on the date of your purchase will apply to the purchase.
ORDER
An order is registered on the WEEZEVENT website when you accept these General Terms and Conditions of Sale by checking the box provided for this purpose and confirming your order. In accordance with the provisions of Article 1127-2 of the Civil Code, the Customer has the opportunity to check the details of their order, its total price and to correct any errors before confirming their acceptance. This validation implies acceptance of all of these General Terms and Conditions of Sale and constitutes proof of the contract.
It is therefore your responsibility to check the accuracy of the order and to report any errors immediately.
The sale of tickets will only be considered final after WEEZEVENT has sent you confirmation of acceptance of the order, by email and after receipt of the full price.
WEEZEVENT reserves the right to cancel or refuse any order from a Customer with whom it exists
a dispute relating to the payment of a previous order.
TICKET PRICES
Ticket prices are indicated with the currency and, depending on the case, excluding taxes or including all taxes and, depending on the case, including or not the rental fees, and, where applicable, the management fees. When the fees are excluded from the ticket price, they are presented at the start of the purchase process with the applicable taxes.
For certain Events, at the request of the Organizers, you will receive countermarks instead of Tickets: in this case, unless otherwise indicated, the Tickets must be collected, in exchange for the countermarks, at the entrance to the venue, 30 minutes before the start of the Event.
All orders, regardless of their origin, are only payable in the currency indicated during the order process.
WEEZEVENT reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time orders are placed.
AVAILABILITY AND ROOM PLAN
You are informed, in real time, when placing the order, of the availability of the desired Tickets.
If all or part of the Tickets in the desired category are unavailable, WEEZEVENT will let you know and you will then be able to purchase Tickets in another category, subject to availability.
If the number of Tickets you requested was greater than the number of Tickets available in the chosen category or in another category offered, WEEZEVENT may allocate you non-contiguous seats.
In any event, you will be able to check that the order matches your wishes when you confirm the order.
WEEZEVENT provides you with a seating plan during the booking process, provided that the Organizer has provided it to WEEZEVENT and that the seats are numbered. This seating location has no contractual value and is provided for information purposes only.
PAYMENTS
For paid Ticket orders, you must make your payments by credit card directly on the WEEZEVENT Sites. WEEZEVENT accepts payments from credit cards from the CARTE BLEUE / VISA and EUROCARD / MASTERCARD networks as well as other possible networks mentioned during the payment step.
Your bank account will be debited with the amount of the order, upon final validation of the transaction in the case of a secure CB payment, except in the case where you are on deferred debit in which case this debit will be effective on your bank account at the end of the month.
Proof of order, as well as an invoice if the Organizer has activated the option, will be automatically sent to you by email as soon as the payment has been recorded.
If the Organizer allows it, you can also book a Ticket by choosing “Offline Payment”. In this case, we will only register a reservation: you will have to make the payment directly to the Organizer under the conditions defined by the latter.
To be valid, the Ticket must not have been the subject of an opposition or unpaid amount on the bank card used for the order, in which case the barcode will be deactivated: you will then not be able to access the Event.
The debit of the bank card is independent of the actual printing of the tickets. In any event, the Tickets will be paid even if the Customer fails to print them.
PAYMENT SECURITY
WEEZEVENT uses all reasonably admissible technologies to give its online payment system the greatest reliability. The confidentiality of banking information is guaranteed and secured by the SSL protocol, which systematically checks the validity of access rights when paying by credit card and encrypts all exchanges.
For these payments, WEEZEVENT uses the CIC bank payment solution.
ELECTRONIC TICKET
Upon confirmation of your order, and unless otherwise stated when ordering, you will receive an electronic email containing the digital Ticket (in the body of the message or as an attachment) to print at home on A4 paper.
Each Ticket has a unique barcode that allows you to access the Event. Only one person may access the Event with a Ticket. Therefore, in the event of loss, theft, or duplication of a valid Ticket, only the first person holding the Ticket will be able to access the Event. You remain responsible for the use made of your Ticket.
PRINTING CONDITIONS AND VALIDITY OF THE TICKET
This Ticket is only valid if printed on blank white A4 paper and printed on both sides. The print format must not have been altered, the printing must be of good quality and all information contained on the Ticket must be legible. Printing can be done in black and white or in color.
Partially printed, soiled, damaged or illegible Tickets may not be accepted and considered in fact as invalid by the Organizer.
The Organizer may also accept other methods of presenting the Ticket: mobile phone, tablet, etc. These possibilities may be presented, where appropriate, during the ordering process.
USE AND VALIDITY OF THE TICKET
The Ticket is neither exchangeable nor refundable.
It is personal to you and is non-transferable, except with the express authorization of the Organizer. It is possible that the Organizer did not wish to make each of the Tickets nominative, in which case they bear exclusively the same identity, namely that of the buyer provided when ordering. In any event, the Ticket may not be sold for a face value higher than that indicated on the Ticket. WEEZEVENT reserves the right to take legal action against Buyers who offer Tickets for sale at a price higher than their face value.
The illegal sale of Event access tickets (entrance tickets, invitations, badges, passes, etc.) in public places, in private places or on the Internet is a criminal offense punishable by arrest and questioning by the police, punishable by a fine of €15,000 (art L 313-6-2 of the Penal Code).
The Ticket is only valid for the specific location, session, date, and time of the Event. After the start time, access to the Event is no longer guaranteed: in this case, you will not be entitled to any refund. You are advised to arrive before the start of the Event, at least 30 minutes in advance.
Some of the times indicated by the Organizer may be strict deadlines with no tolerance for late entry.
Any person who does not comply with the regulations and special provisions, the General Terms and Conditions, may be refused entry to the event or expelled without being able to claim a ticket refund.
TICKET CONTROL AND ACCESS TO THE EVENT
The Organizer is responsible for ensuring the control of the Tickets unless it has delegated this task to a third party. The unique barcode and the Ticket identifier, if applicable, will allow the validity of each Ticket to be verified.
For nominative Tickets, the Organizer always has the option of checking your identity at the entrance to the venue where the Event is taking place. You must therefore have a valid official ID document with a photo if you wish to access the Event.
The Organizer may, when setting up the Event, indicate any other supporting documents that must be presented at the entrance to the venue where the Event is taking place. In this case, you will be informed prior to the Event and the Organizer may request the presentation of said supporting documents.
You must keep your Ticket or the standard 2-stub Ticket that may have been given to you upon access to the Event by the Organizer for the entire duration of the Event.
Please note that the Organizer is not obliged to verify the identity of the person in possession of the Print-at-Home Ticket, nor to verify the authenticity of the Print-at-Home Ticket since the copy of the Print-at-Home Ticket cannot be detected with certainty. Also, please note that you are responsible for keeping your Ticket and that access to the Event may be refused even if your name appears on the Ticket, you will then not be entitled to any reimbursement.
FRAUD
It is strictly forbidden to reproduce, duplicate, or counterfeit a Ticket in any way whatsoever. The person who reproduced the Ticket and the user of the copy of the Ticket are liable to prosecution. In the event of loss or theft, WEEZEVENT declines all responsibility for illicit use of the Ticket. Any lost or stolen Ticket is neither exchangeable nor refundable. In the event of loss, theft, or duplication of the Ticket, please contact the Event Organizer.
WITHDRAWAL PERIOD, CANCELLATION AND REFUND
In accordance with Article L.221-28 paragraph 12 of the French Consumer Code, Tickets are not subject to a right of withdrawal. All orders are firm and final.
A Ticket cannot be returned, exchanged or refunded even in the event of loss or theft.
A Ticket may only be refunded in the event of cancellation of the Event and only upon decision of the Organizer. WEEZEVENT reminds that it only intervenes at the marketing stage as an intermediary for the Organizer and it is not intended to receive the price of the tickets that are marketed by the Organizer. Thus, WEEZEVENT cannot be held liable for any refund if it is not in possession of the price of the tickets and it cannot replace
the Organizer within the framework of its obligations.
In this context, WEEZEVENT will only make a refund if it has been enabled to make the refund by the Organizer.
You will be informed of any cancellation, postponement, or modification of the Event by WEEZEVENT if and only if WEEZEVENT has been previously informed by the Organizer. We therefore invite you to stay in contact with the Organizer to be informed of the proper conduct of the Event.
In the event that WEEZEVENT is able to make the refund on behalf of the Organizer, only buyers who placed an order on the WEEZEVENT website and whose name appears on the Ticket may be refunded.
Your refund, excluding bookings made via "Offline Payment", will only be made by WEEZEVENT and on behalf of the Organizer if the Organizer has made or has left at the disposal of WEEZEVENT the necessary sums to make the refund. Indeed, WEEZEVENT is only involved in the operation as an intermediary for the Organizer and is not personally liable for the refund. Furthermore, the refund can only be made:
- If the Organizer has voluntarily requested reimbursement from buyers,
- Or if the Organizer has accepted the buyers' refund request.
By purchasing a Ticket on the WEEZEVENT website, you expressly agree to waive any recourse against WEEZEVENT for reimbursement purposes, as WEEZEVENT is not entitled to receive the price of the tickets. WEEZEVENT will, however, do everything possible to enable you to obtain a refund from the Organizer.
Please note that any decision to cancel, postpone or modify an Event is the responsibility of the Organizer and that WEEZEVENT cannot replace the latter.
In the event of cancellation of an Event, the rental fees will, in any event, be retained by WEEZEVENT. In these cases, only the price of the Ticket will be refunded.
BEHAVIOR TO ADOPT DURING THE EVENT
You must follow the Organizer's instructions when you are at the Event location.
The Internal Regulations of the Event may, where applicable, be consulted, either directly on the Organizer's website, or before accessing the Event, or following their transmission by the Organizer by e-mail and prior to the Event.
Except in special circumstances, photography, filming or recording is prohibited during the Event.
RESALE / REFUND MODULE
The Organizer, particularly in the case of Events that are sold out, has the possibility, via the Software, to offer participants who wish to be reimbursed for their Ticket, and to offer new participants the opportunity to purchase new Tickets in a “resale” module.
This reimbursement at a fixed price or within a price range defined by the Organizer is only effective for the participant in the event and at the same time as the purchase of a new Ticket of the same category by a new participant. This new Ticket is sold at the sale price freely set by the Organizer.
The new Ticket and its generated barcode, the subject of the new sale, then replaces the participant's initial Ticket in the overall gauge of the event, it being specified that the reimbursement of the initial Ticket immediately results in the invalidity of all rights attached to it.
In this context and in the event that several participants have requested a refund, the order of refund will follow the order of resale requests made on a first-come, first-served basis.
In the case of a price range defined by the Organizer, it is up to the Participant to define the price at which they wish to be reimbursed within this range. This price set by the participant then has an impact on the order in which the Ticket appears on the resale module, these being listed in ascending price order.
Furthermore, the Organizer may, at its discretion, set so-called “resale” fees which will be deducted from the amount that would be refunded to you.
Also, in the event that the Organizer has activated this possibility and you request a refund for your Ticket, you will receive an email summarizing your request and reminding you of any fees applied by the Organizer, the amount of the refund due to you and which could occur if the conditions set out above were met.
Please note that by activating this request, your Ticket can be refunded at any time to the payment method used for your initial order, without any confirmation being requested.
An email informing you of the refund will then be sent to the email address used for your order.
However, as long as you have not received this email, you can cancel or modify the refund request from the same interface used for the refund request. Under the same conditions, WEEZEVENT may cancel this request at any time, without WEEZEVENT being held liable.
WEEZEVENT will under no circumstances be required to reimburse you for the value of your Ticket.
RESPONSIBILITY – APPLICABLE LAW – MEDIATION
In accordance with Law No. 2004-575 of June 21, 2004, Article L 121-20-3 of the Consumer Code, WEEZEVENT is fully liable to the consumer for the proper performance of the obligations resulting from the contract concluded remotely. As such, WEEZEVENT is responsible to you for the proper transmission of the Ticket and, where applicable, for the proper execution of the payment. It is recalled that the choice to use WEEZEVENT services rather than another ticket sales channel is your sole responsibility.
WEEZEVENT cannot, however, be held responsible for the smooth running of the Event and the proper execution of the Organizer's obligations, particularly concerning the holding of the Event and compliance with health and safety rules.
WEEZEVENT only acts on behalf of the Organizer, in the context of the marketing of Tickets and you remain entirely responsible for the choice of the Event and the choice of the Organizer.
The sales of Tickets referred to herein are subject to French law.
In the event of disputes, the French courts shall have sole jurisdiction.
Generally speaking, Events take place under the sole responsibility of the Organizer. Indeed, WEEZEVENT acts on behalf of the Organizer within the limited framework of the marketing of Tickets. WEEZEVENT cannot be held liable for reasons that are not within its jurisdiction, including in particular:
- Cancellation of the Event,
- Modification of the Event by the Organizer,
- The postponement of the Event,
- And generally, any incident that may occur during the Event.
PERSONAL DATA
The personal data you provide us with is only used to enable the transaction to be completed and to retain proof thereof. This information also allows us to send you the Ticket(s) you have ordered and possibly to contact you, where possible, in the event of cancellation or change of date, time or location of an Event for which you are registered. This information is by default, the name, first name, email address and telephone number of the participant and sometimes, depending on the needs necessary for the organization of the Event, the company, the participant's date of birth, postal address, a photograph allowing identification, etc. For traceability purposes, the buyer's IP address and payment references with the banking service provider are also kept.
This data allows in particular:
- Your identification,
- Verification that you are authorized to participate in the Event,
- Verification of the specific conditions for one or other of the Event's price categories,
- Interoperability with third-party access control solutions,
- The dissemination of practical information on the progress of the Event,
- The preservation of proof of the transaction.
You are reminded that the Organizer sets up the Event itself before marketing the Ticket, so that the personal data processed is more generally all the information whose communication will be requested by the Organizer when setting up the Event.
You have the right to access and rectify your personal data at any time with WEEZEVENT concerning the data that it is required to collect and store as part of its own obligations (art. 34 of the French Data Protection Act of 6 January 1978). By confirming your order, you agree that WEEZEVENT may transmit your personal data to the Organizer. It is recalled that it is the Organizer who informs WEEZEVENT about the data it intends to obtain. Any order acceptance therefore implies recognition of the transmission of the information provided to the Organizer. In accordance with legal provisions, the transmission of data is necessary for the proper execution of the contract between you and the Organizer. As such, WEEZEVENT cannot be held responsible for any use that may be made of this data by the Organizer. You may also exercise your rights directly with the Organizer of the Event (right of access, rectification, erasure and opposition, right to limit processing, right to data portability, right not to be subject to an automated individual decision (including profiling).
Finally, we inform you that we may also share your data with our own service providers. In this context, we strive to ensure that our service providers ensure confidentiality.
